Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the OpenEphemeris API, website, documentation, customer dashboard, and related services (collectively, the “Service”), operated by Spirit River Inc, a Delaware corporation.

This AUP is incorporated by reference into the Terms of Service. Violation of this AUP may result in suspension or termination of your account as described in Section 7.

You may use the Service for any lawful purpose, including but not limited to:

• Building applications that integrate ephemeris or astrological computations
• Conducting astronomical or astrological research, education, or analysis
• Developing consumer-facing astrology, astronomy, tidal, or timekeeping applications
• Automating ephemeris data retrieval for scientific, educational, or commercial workflows
• Internal business tools, analytics dashboards, or custom reporting
• Integration with AI and machine learning systems, subject to Section 6

3.1 Illegal Activity

You must not use the Service for any purpose that violates any applicable law or regulation, including facilitating fraud, violating export control laws, infringing third-party rights, or circumventing legal obligations.

3.2 Security and Infrastructure Attacks

• Probing, scanning, testing, or exploiting vulnerabilities
• Unauthorized access to systems, databases, or accounts
• Denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
• Circumventing rate limiting, authentication, or any security controls
• Generating, hosting, or distributing malware or phishing content

3.3 Reverse Engineering and Competitive Extraction

• Reverse-engineering, decompiling, or deriving source code from the Service, except where prohibited by applicable mandatory law (including EU Directive 2009/24/EC Article 6)
• Systematically harvesting outputs to build a competing service
• Publishing competitive benchmarks without Spirit River's prior written consent

3.4 Data Abuse and Privacy Violations

• Transmitting personal data without a valid legal basis under applicable privacy law
• Facilitating illegal collection, profiling, tracking, or surveillance of individuals
• Attempting to de-anonymize, re-identify, or correlate computation outputs to identify individuals

3.5 Prohibited Application Categories

You must not use the Service as a component of applications that:

• Provide medical diagnoses or clinical recommendations based on astrological data
• Provide legal advice or strategy based on astrological data
• Provide investment advice or financial trading signals based on astrological data where users may rely on those as authoritative guidance
• Provide psychological diagnoses or mental health treatment recommendations based on astrological data
• Target vulnerable populations with astrological predictions presented as factual or guaranteed
• Deceive end users into believing astrological predictions are scientifically validated

3.7 Unauthorized Resale and Access Sharing

• Reselling, sublicensing, or redistributing API access without written consent
• Creating proxy or relay services under your credentials
• Exposing API Keys in public repositories or client-side code

3.8 Resource Abuse

• Making requests to artificially inflate metrics or manipulate billing
• Creating multiple accounts to accumulate free-tier allocations
• Conducting load testing or stress testing without prior authorization from Spirit River

If you build applications for end users (“Downstream Products”), you must:

• Maintain your own terms of service and privacy policy
• Not represent that Spirit River endorses or is affiliated with your product
• Comply with the disclaimer requirements in Section 5 for astrological content
• Accept sole responsibility for data you collect from your end users

Any Downstream Product that presents astrological interpretations, predictions, or insights to consumers must include a clear, conspicuous disclaimer substantially similar to:

The disclaimer must be displayed in a manner clearly visible to end users before or at the point where astrological content is presented. Acceptable placements include: a footer on every page with astrological content, a dedicated disclaimer page linked from the primary navigation, or a first-use acknowledgment dialog.

If you incorporate OpenEphemeris API outputs into AI systems, ML models, LLMs, or AI-generated content pipelines, you agree to:

• Clearly disclose to end users when content is AI-generated and incorporates astrological data
• Include the Section 5 disclaimer in all AI-generated astrological content
• Not represent that AI-generated astrological content has scientific validity or guaranteed accuracy
• Comply with all applicable AI transparency requirements, including the EU AI Act (Regulation (EU) 2024/1689) where applicable
• Accept sole responsibility for AI outputs, including inaccuracies, hallucinations, or misrepresentations

Spirit River's computation outputs are raw mathematical data. Spirit River does not control, review, or endorse any interpretations generated by your AI systems.

If you believe enforcement was taken in error, submit a written appeal to legal@openephemeris.com within thirty (30) days. Spirit River will respond within fourteen (14) business days.
